The seasonal rush to online shops is well and truly in full swing.  However, Santa's bags would be very light if we did not know where to find the favourite brands of Santa's clientele in the online wold.  Since there are obviously a number of people in the legislature who still believe in Santa, they have put in place a legal framework which regulates the role of trademarks of brands in domain names, keywords and links. This seminar will discuss the most important aspects of this legal framework and answer questions like: When will use of a domain name infringe a trade mark or contravene the Australian Consumer Law? 

Samantha Waldon

Samantha’s practice as a solicitor and Trade Marks Attorney has centred in the fields of Intellectual Property and commercial law. Her most recent role at Pym’s Technology Lawyers had a strong focus in working with the ICT sector, including IT licensing, advising start-ups and procurement. Previously Samantha was part of the in-house team at the Legal Services Unit at University of Wollongong, working closely with the University’s commercialisation unit, as well as the protection of use of University branding online, and before that, Samantha was a Solicitor at Dilanchian Lawyers in Sydney, a boutique Intellectual Property law firm.

This year Samantha also commenced lecturing part-time at University of Wollongong, delivering the Intellectual Property subject to undergraduate students.
